1.2 This agreement outlines your rights, responsibilities, and limitations when interacting with ENG Properties through our digital platforms or physical sales processes.

1.3 These Terms apply to all property investments, real estate transactions, marketing communications, and digital engagements related to our current and future projects in the United Arab Emirates.

1.4 If you do not agree to these Terms & Conditions, you are advised not to use our website, services, or enter into any form of business engagement with ENG Properties.

2. Company Overview

2.1 ENG Properties is a licensed and RERA-registered real estate development company based in Dubai, UAE.

2.2 We specialize in the planning, development, and sale of premium residential and commercial real estate projects across key locations in the UAE.

2.3 Our operations comply fully with the rules and regulations set by the Dubai Land Department (DLD), Real Estate Regulatory Authority (RERA), and other relevant UAE government bodies.

3. Property Listings & Project Information

3.1 All property visuals, architectural renderings, layout plans, brochures, specifications, and videos featured on our website or promotional material are for illustration purposes only.

3.2 ENG Properties reserves the right to change or modify designs, unit configurations, specifications, amenities, floor areas, and prices without prior notice.

3.3 Estimated delivery timelines, handover schedules, and project milestones are subject to regulatory approvals and construction dependencies, and may be revised without liability.

4. Booking & Payment Terms

4.1 A booking is only confirmed once the initial booking amount has been received and a formal Sales Purchase Agreement (SPA) or Booking Form has been signed.

4.2 All payment plans are project-specific and shall be clearly communicated to the buyer in writing before booking confirmation.

4.3 Delays or defaults in payment may result in penalties, late charges, suspension of services, or cancellation as per the terms outlined in the SPA.

4.4 Payments must be made only to authorized ENG Properties bank accounts. The company is not liable for payments made to unauthorized individuals or agents.

5. Cancellation & Refund Policy

5.1 Cancellation requests initiated by the client are subject to the policies outlined in the signed SPA and governed under the applicable UAE real estate laws.

5.2 Refunds (if applicable) will be processed within 90 business days of cancellation approval, subject to deductions including administrative fees, government charges, and construction costs incurred.

5.3 ENG Properties retains the right to cancel any booking due to violation of agreement terms, with or without refund depending on the circumstances.

6. Handover & Possession

6.1 Possession of any property unit will only be granted upon successful completion of all required payments including base price, maintenance charges, DLD registration fees, and applicable service charges.

6.2 The client will be notified formally when the unit is ready for handover, and is required to complete all necessary documentation and formalities before possession.

6.3 ENG Properties is not responsible for handover delays caused by force majeure events, regulatory issues, or third-party contractor delays.

7. Use of Website

7.1 All content on the ENG Properties website including but not limited to text, images, videos, icons, layouts, and brand elements is protected by intellectual property law.

7.2 Unauthorized use, reproduction, redistribution, or commercial exploitation of website content is strictly prohibited.

7.3 Users must not upload false, defamatory, or illegal content or attempt to breach the security or data infrastructure of the website.

8. Marketing Communication & Data Use

8.1 By submitting your personal information on our website, you consent to receive communication from ENG Properties via email, WhatsApp, phone, or SMS regarding projects, offers, and updates.

8.2 You may opt out of future marketing communications at any time by clicking “unsubscribe” in our emails or contacting us directly.

8.3 ENG Properties respects your privacy. Any personal data collected will be stored securely and will not be shared with third parties unless required to deliver a requested service.

9. Third-Party Services Disclaimer

9.2 Such referrals are offered for convenience only, and ENG Properties bears no responsibility for service quality, costs, or outcomes.

9.3 Clients are encouraged to conduct their own due diligence before engaging with any third-party provider.

10. Limitation of Liability

10.1 ENG Properties is not liable for any financial loss, market fluctuation, or real estate investment risk resulting from buyer decisions.

10.2 No guarantees are made regarding future property value appreciation, rental yields, or return on investment (ROI).

10.3 The company's total liability, if any, is limited to the provisions explicitly stated in the signed SPA or other binding agreements.

11. Legal Jurisdiction

11.1 All agreements, transactions, and website usage shall be governed by the laws of the United Arab Emirates.

11.2 Any disputes arising from dealings with ENG Properties will be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

12. Amendments to Terms

12.1 ENG Properties reserves the right to amend or update these Terms & Conditions at any time, without prior notice.

12.2 Changes will be published on the official website. Continued use of our website or services implies acceptance of updated terms.
